1. The contest: The "YQB : La totale" contest (referred to here as the "Contest") is organized by Aéroport de Québec Inc. (referred to here as the "Organizer"). It will take place on the website www.instagram.com from 8:30 a.m. (EST) on Friday, July 5, 2019 to 11:59 p.m. (EST) on Saturday, August 31, 2019 (referred to here as the "contest period").
2. ELIGIBILITY
2.1.1. The Contest is open to all residents of Québec aged 18 or over, with the exception of employees, agents and representatives of the Contest Organizer and its subsidiaries, its advertising and promotion agencies, its partners, and any other party directly involved in the Contest, including their immediate family members and all persons with whom such employees, agents or representatives live and members of their immediate family. For the purposes of these Rules, "immediate family" means the father, mother, brother or sister, child, husband or wife, or de facto spouse of an employee, agent or representative.
3. PARTICIPATION
To participate via an Instagram account, you must
3.1. Go to the Instagram profile of Jean Lesage Québec City International Airport (https://www.instagram.com/quebecyqb/);
3.2. Leave a comment on a Contest post, correctly identifying the zone in the Jean Lesage Québec City International Airport shown in the deconstructed image;
3.3. No purchase is required.
4. PRIZE
4.1. The Contest offers a single prize, worth approximately $750.00. It comprises a parking reservation for the duration of the winner's trip, starting at Québec City (YQB); two entries to the VIP Lounge in the Québec City (YQB) departure area for the winner and his/her guest; and a $500 prepaid credit card (all referred to here as the "Prize"). The Prize may be transferred to a person of the winner's choice. The winner cannot choose between the prize and a cash equivalent. The winner has until December 31, 2021 to claim the prize.
5. DRAW AND CHANCE OF WINNING
The deadline for participating in the Contest is 11:59 p.m. on August 30, 2019. The answers, submitted as comments on the Instagram posts for the Contest, will be assess and selected by a panel of judges. One winner will be selected by random draw on Friday, September 6, 2019. The winner will be contacted on the same date, September 6, 2019. The chances of a participant being selected as the winner will depend on the number of entries received and registered during the contest period and the number of entries submitted by a participant during the contest period, and on the discretionary powers of the panel of judges.
6. AWARD OF PRIZE
To be declared the winner, the selected participant must
6.1. be informed in person, via Instagram on September 6, 2019. The winner will receive all the details needed to contact AQi by E-mail, within a maximum of seventy-two (72) hours; failing this, another draw may take place to designate another winner. If a notification E-mail is sent and a non-delivery notification is received, AQi will conduct another draw;
6.2. complete and sign the declaration form and liability waiver (the "Declaration Form"), indicating compliance with all the conditions set out in these Rules, and return it to AQi within seventy-two (72) hours after receiving it;
6.3. reply correctly to the mathematical skill question on the Declaration Form;
6.4. provide a photo identity document on request at a suitable time;
6.5. consent to the publication, by AQi, of the winner's photograph on various platforms (Facebook, Instagram, Twitter, etc.) to announce the Contest winner. Consent must be given using the Declaration Form.
A selected participant who fails to comply with a condition of these Rules or fails to accept the prize will be disqualified. In such a case, AQi may, at its sole discretion, cancel the prize or conduct a new draw to select and declare a new winner.
7. GENERAL CONDITIONS
7.1. Disqualification and exclusion – AQi reserves the right, at its sole discretion, to cancel one or more entries made by a person or to disqualify a person from this Contest or exclude the person from any future contest or promotion organized by AQi if the person participates or attempts to participate in the Contest using a means that is contrary to these Rules, is suspected of influencing the organization of the Contest, makes a false statement concerning the person's participation, or infringes these Rules. The person may be reported to the competent judicial authorities.
7.2. Contest procedure – Any attempt to deliberately cause harm to the Contest or to any related website, or to sabotage the legitimate Contest procedure, constitutes a violation of civil and criminal law. In the event of such an attempt, AQi reserves the right to reject the entry made by the participant and to obtain reparation in accordance with law.
7.3. Acceptance of prize – The prize must be accepted as described in these Rules and may in no case be replaced by another prize.
7.4. Limitation of liability – By participating in this Contest, the winner relieves AQi and its employees of all liability for any harm the winner may sustain by accepting and using the prize, and in particular any tax implications.
7.5. Instagram functionality – AQi makes no guarantee of any kind that the Instagram platform or any related site will be accessible or functional without interruption during the contest period or will be free of error.
7.6. Contest functionality – AQi declines all responsibility for the failure of any computer hardware or software or communication link, for any loss or lack or network communication or any defective, incomplete, unintelligible or erased transmission caused by any hardware or network that may limit or prevent participation in the Contest. AQi declines all liability or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any webpage connected to participation in the Contest.
7.7. Changes to the Contest – AQi reserves the right, at its sole discretion, to cancel, terminate, change or suspend the Contest, in whole or in part, in particular if an event or human action alters or influences the administration, safety, impartiality or procedure of the Contest as provided for in these Rules, subject to approval from the Régie des alcools des courses et des jeux du Québec, if required.
7.8. End of participation in the Contest – If the computer system is unable to record all entries during the contest period, for whatever reason, or if participation in the Contest must end, in whole or in part, before the scheduled date, the draw may take place, at the discretion of AQi, among the entries duly recorded during the contest period or, if applicable, up to the time of the event that ended participation in the Contest.
7.9. Prize limit – In no case may AQi be required to allocate more prizes or allocate a prize otherwise than in accordance with these Rules.
7.10. Participation in the Contest – By participating or attempting to participate in this Contest, each participant relieves AQi of liability for any damage the participant may sustain by participating or attempting to participate in the Contest.
7.11. Authorization – By participating in the Contest, the finalist authorizes the Contest organizers and their representatives to use, if required, the finalist's name, photograph, image, voice, place of residence and statements concerning the prize for advertising purposes, without any form of remuneration.
7.12. Communication with participants – No communication or correspondence will be entered into with participants in connection with this Contest otherwise than in compliance with these Rules or on the initiative of the Contest organizers.
7.13. Personal information – The personal information on participants gathered during the Contest will be used only for the purposes of the Contest. No communication, whether commercial or not, that is not connected to the Contest will be sent to participants unless they have consented to receive it.
7.14. Property – The Declaration Form is the property of AQi and will not be returned to the participant.
7.15. Identification of participant – For the purpose of these Rules, the participant is the person whose name is associated with the Instagram account, and this is the person to whom the prize will be awarded if selected and declared the winner, subject to the next paragraph.
7.16. AQi decision – Any decision by AQi concerning this Contest is final and cannot be appealed, subject to a decision made by the Régie des alcools, des courses et des jeux du Québec concerning any matter under its responsibility.
7.17. Dispute – A dispute concerning the organization and conduct of a publicity contest can be submitted to the Régie des alcools, des courses et des jeux du Québec for a decision. A dispute concerning the allocation of the prize can only be submitted to the Régie as part of an intervention to attempt to settle the dispute.
7.18. Instagram platform – This Contest is not associated with, managed by or sponsored by Instagram. Any question, complaint or comment concerning the Contest must be submitted to AQi and not to Instagram. Instagram is not responsible for any claim arising from or relating to the organization of the Contest. By participating in the Contest, participants undertake to comply with the terms and conditions of use, the contracts and the other policies and/or guidelines governing the Instagram platform. Participants also relieve AQi of liability for any harm they may sustain through use of the Instagram platform.
